Terms and conditions

These terms apply to the betton.es site and to all sales by BETTON DESIGN STUDIO S.L. — at the showroom and against a quote — unless the quote or a written contract says otherwise. By accepting a quote, an order or an invoice, or by receiving goods or a service, you accept these terms. A client's own terms apply only if we have accepted them in writing.

The site

Photos, descriptions and prices on the site are for guidance only and are not an offer. Stone, wood and ceramics look different on a screen than in real life, so choose from the samples at the showroom. The factories set the range and the specifications and can change them without notice.

The site's texts, photos and design are protected by copyright. Brand names and logos belong to the factories.

Requests through the forms

Asking for a visit, a consultation or a training place is not a contract: we reply and agree a meeting. Use your real name and contact details, or we cannot reply. What we do with this data is in the Privacy policy.

Quote and order

Every order starts with a quote. It lists the items, prices, payment method and schedule, the estimated delivery time and how long the quote is valid. Until we confirm the order, we may change or withdraw the quote; the order depends on what the factory has available.

The contract starts when you accept the quote in writing and make the payment it states. Accepting a quote, an order or an invoice by email or electronically has the same force as signing on paper.

Prices are in euros and include VAT (IVA), unless the quote says otherwise. Delivery, carrying upstairs, installation and other services are part of the order only if the quote includes them.

Payment and invoices

Pay the invoice by the date shown on it or on the order. If no date is shown, pay within 30 calendar days of the invoice date, by a payment method we accept.

If payment is late, we may charge late-payment interest and collection costs under Spanish law and put pending deliveries and work on hold. If the debt is still unpaid 60 days after the due date, we may pass it to a collection agency or go to court; the client bears these costs as far as the law allows.

If the law of the client's country requires tax to be withheld from the payment, the client bears it: we must receive the full amount of the invoice.

Ownership and risk

The goods remain the property of BETTON DESIGN STUDIO S.L. until the client has paid everything owed. The risk of damage passes to a business client when we hand the goods to the carrier, and to a consumer when they receive the goods, unless they chose the carrier themselves.

Delivery times and receipt

Factories make most items to order, so delivery times are estimates: they depend on production and on the carrier. If a date changes, we tell you straight away. We are not liable for delays caused by factories, carriers or other third parties.

When the goods arrive, check the packaging and count the packages while the carrier is still there. Write any damage on the delivery note, take photos and email us the same day.

Cancellations and returns

A confirmed order cannot be cancelled, changed or returned without our written consent. When you buy at the showroom, you buy in person, and the law gives no right to cancel without a reason.

The exception is a contract with a consumer made at a distance — by email or phone, without a visit. Then the consumer can cancel it within 14 calendar days of receiving the goods, without giving a reason. To cancel, email us and send the goods back within those 14 days; you pay for the return shipping. We refund you within 14 days using the same payment method, but we may wait until the goods are back with us. The right to cancel does not apply to goods made to your specifications: size, finish, colour, cut or configuration.

Complaints

Send any complaint about an invoice, goods or a service in writing within 14 calendar days of receiving them — to info@betton.es or to the showroom address: Carrer de Provença, 22, 08029, Barcelona, Spain. If no complaint arrives in that time, the invoice is treated as accepted. This time limit does not shorten the legal warranty for consumers.

Warranty

If you buy as a consumer, the goods have a legal warranty of three years from delivery. If they do not match the contract, we repair or replace them free of charge; if that is not possible, we lower the price or cancel the contract. This is required by Spanish consumer law, RDL 1/2007.

The warranty does not cover damage from wrong installation, care that ignores the factory's instructions, normal wear, or repairs by third parties.

Natural stone, wood, veneer and ceramics vary in shade, grain and calibre from batch to batch. This is a property of the material, not a defect: a sample shows the character of the material but does not match a specific batch.

You need the invoice for any warranty claim, so keep it. For companies and professionals, we set the warranty terms in the quote.

Liability

We make every reasonable effort to meet the agreed dates and terms. We are not liable for indirect losses, lost profits or consequences of using the goods and services. This limit does not apply where the law forbids it, including towards consumers.

Force majeure

We are not liable for delays or failures caused by events we cannot control: logistics or supply problems, strikes, transport failures, natural disasters, technical incidents, decisions by the authorities. While such events last, obligations are put on hold. If they last more than three months, either side can cancel the contract without penalty, and we refund what you paid for goods not delivered.

Personal data

We use client data only to handle the order and to meet our legal duties. The details are in the Privacy policy.

General provisions

If any clause turns out to be invalid, the rest stay in force.

We may update these terms. Each order follows the version in force on the day you accepted the quote.

These terms are translated into English and Russian; if the versions differ, the Spanish version prevails.

Law and courts

These terms are governed by Spanish law. Disputes with BETTON DESIGN STUDIO S.L. go to the courts of its registered office. A consumer can go to the courts of their home address: the law guarantees this right.
